Consumer Health Data Privacy Notice #

This Consumer Health Data Privacy Notice (“Notice”) describes our practices for handling information about you that is “consumer health data,” as defined in Washington’s My Health My Data Act and other similar state laws.  This Notice supplements our Privacy Notice, which describes our practices for handling the information we collect about you, including consumer health data, through the websites and online services that we operate and that link to our Privacy Notice.

When this policy refers to ourselves as “we,” “our”, or “NeuroCytonix,” it means NeuroCytonix, Inc., to the extent that they are collecting consumer health data that is subject to Washington’s My Health My Data Act and other similar state laws.

We reserve the right to amend this Notice at our discretion.  When changes are made to this Notice, we will post the updated policy and the date the last revisions were made.  We encourage you to periodically review this page for the most current Notice.

How We May Collect Consumer Health Data #

As described in our Privacy Notice, we collect information from you when you use our website.  Some categories of information that we collect could be considered consumer health data, such as:

  • Contact information, such as your name, email address, telephone or mobile phone number, mailing address, to the extent such information identifies your past, present, or future health status;
  • Health and medical information, such as your medical conditions, physical or mental disability, treatments for medical conditions, information about medications you take;
  • Internet and electronic network activity information, such as your IP address and information about your interaction with our online services, to the extent such information identifies your past, present, or future health status;
  • Other personal information that identifies or may be used to identify your past, present, or future health status.

How We May Use Consumer Health Data #

We may use consumer health data for the purposes described in our Privacy Notice, including for business and commercial purposes as reasonably necessary to provide you with the information, products and services that you request from us.  This includes to operate our business and administer our services; to keep our services, business, and users safe and secure; to comply with our applicable legal and regulatory obligations; and to analyze the use of our products and service.  We may also use your consumer health data for other purposes with your consent, such as to communicate with you about the products and services we offer, and as otherwise permitted or required by law.

How We May Share Consumer Health Data #

We may share the categories of consumer health data listed above as reasonably necessary to provide you with requested products or services and as otherwise permitted by law.  The types of individuals or entities to whom we disclose consumer health data include:

  • Authorized third-party vendors and service providers in connection with business services they are providing with or on behalf of us.
  • Our corporate affiliates and subsidiaries.
  • For legal purposes, such as to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims or government inquiries, to comply with legal and regulatory requirements, and to protect and defend the rights, interests, safety, and security of NeuroCytonix, our affiliates, users, or the public.

We may also share your consumer health data pursuant to your consent.

Note that it may be possible for third parties to collect consumer health data over time and across different websites, including our websites.

Your Rights #

Depending on where you live, you may have certain rights under applicable laws with respect to your consumer health data, including the rights to know, access, request changes, delete, or withdraw consent relating to our use of your consumer health data, subject to certain exceptions. You may be entitled in accordance with applicable law to appeal a refusal to take action on your request. If your request is denied, you may be able to appeal any decision we have made about your request by contacting your state’s regulators for further assistance.
